We have successfully handled several large claims by and against estate executors and trustees accused of asset mismanagement, self-dealing, and other breaches of fiduciary duties. Trust and probate matters that we have handled for our clients include:

  • Representation of the executor of the estates of the majority shareholders of a closely held corporation in an action against the corporation’s senior corporate officers who had arranged to purchase the corporation for an amount far below the corporation’s fair value. Ownership of the corporate stock was restored to the estates as a result of the successful litigation of the claims.

  • Representation of a trust beneficiary's guardian against a national bank for breach of trust in connection with the bank-trustee's agreement to sell the trust's holdings in a closely held corporation, resulting in a $17.3 million judgment in favor of the beneficiary.

  • Successful defense of the trustees of a $250 million family trust in a suit by the trust's beneficiaries for damages and removal of the trustees.

  • Settlement of will contest for client who had been substantially written out of her husband's will in favor of his closely held company's management and lawyer.
