Trade Secrets/Copyright:

Order vacating an arbitration award against employees in action brought by former employer alleging misappropriation of trade secrets, copyright infringement and breach of contract. The firm defended the former employees pro bono in the arbitration proceeding and the appeal to the federal district court.

Take-nothing judgment in favor of Fortune 500 data processing company following three week arbitration hearing on a competitor’s claim for $100,000,000 damages for alleged misappropriation of computer software trade secrets and misappropriation of confidential information.

Fiduciary Duty/Investments:

Successful defense of national bank and settlement for nuisance value of $100,000,000 suit by trust beneficiary alleging breach of trust and mismanagement of trust investments.

Successful defense and exoneration of trustees of a $250,000,000 family trust in suit by beneficiaries for removal, an accounting, and damages.

Construction Contract:

Successful defense and favorable resolution of lawsuit against international plastics manufacturer by contractor to recover multi-million dollar retainage and early completion bonus arising out of construction of a polyethylene plant.

Tortious Interference/Fraud:

Successful defense and $1,500,000 counterclaim recovery for estate beneficiary in claims by executor for tortious interference, breach of contract, and fraud.

Class Action/Discrimination:

Successful defense of national financial services company by defeating class certification in nationwide class action alleging race discrimination.

Lender Liability:

Take-nothing judgment and $700,000 recovery on counterclaim for national bank in suit alleging breach of loan commitment.

Take-nothing judgment and $250,000 recovery on counterclaim for national bank in suit alleging actual and punitive damages for wrongful offset and breach of contract.

Successful defense of national mortgage company in arbitration of dispute concerning sale of multi-million dollar loan portfolio.

Judgment in favor of interstate pipeline company alleged to have repudiated natural gas purchase agreement.

Take-nothing judgment in favor of national environmental company in claim by telecommunications equipment supplier for breach of contract.

Insurance Bad Faith:

Take-nothing judgment in favor of insurance carrier in claim by insured alleging bad faith denial of medical benefits.

Insurance Contract:

Take-nothing judgment in favor of insurance carrier in claim by insured alleging breach of medical benefits settlement agreement.

Products Liability:

Favorable verdict and judgment for national manufacturer in catastrophic injury claims by contractor’s employee.

Oil & Gas:

Summary judgment for drilling company in oil and gas property surface damages case.

Contract/License Agreement:

Take nothing judgment and affirmative declaratory relief on counterclaim for client, licensor of oilfield technology, in case by licensee alleging breach of license agreement and seeking damages in excess of $26,000,000 per month. Licensee appealed, and the United States Court of Appeals for the Fifth Circuit affirmed the take nothing judgment and affirmative declaratory relief in favor of the firm’s client after briefing and oral argument.

Contract/Tortious Interference:

Confidential settlement of claims for breach of alleged real estate commission sharing agreement and interference with agreement in connection with purchase and lease of commercial real estate.
